We have represented numerous physicians, mental health care professionals, hospital executives, clinics and clinical laboratories in criminal, civil, and licensing matters arising out of health care fraud allegations.

We have defended numerous health care professionals in connection with investigations into Medicare, Medi-Cal and third party insurer billing fraud. These matters typically involve not only the criminal investigation and charges, but also civil qui tam – False Claim Act cases, issues of suspension and exclusion from Medicare and other government programs, and licensing issues before the California Medical Board or other licensing authority.

Example cases include:

Defense of a chain of clinics in a multi-million dollar Medi-Cal billing fraud investigation. Successfully ended the investigation with a favorable civil resolution involving structured payments, a compliance program and no program exclusion, and without any individuals being criminally charged.

Representation of numerous individual physicians and dentists involved in a variety of Medicare or Medi-Cal billing fraud investigations involving upcoding, miscoding, and unnecessary procedures. Cases were resolved civilly, without any criminal charges, program exclusion or licensing problems.

Representation of a clinical laboratory in a Medi-Cal fraud investigation. Matter resolved with a favorable civil settlement without any criminal charges or exclusions.

Representation of a prominent San Diego physician in Medical Board Proceeding including successful writ obtained overturning license revocation.

Defense of a durable medical equipment provider in a Medicare billing fraud investigation. Case resolved with civil settlement.
